It is with great saddness the family of Don Broder announces his passing. Born in Fairview, Alberta, October 11, 1929. The Son of Edmund and Hazel Broder. Don Broder husband to Joyce M. Broder “December 6, 1929 – September 23, 2011”. Father, grandfather, brother and friend, Don loved and admired his children, Craig, Marc, Jeff and Elise Broder and his grandchildren, Danielle, Dylan, Tyree, Reece, Taylor, Danica, Brittney, Stephanie, and Danalyn Broder inclusive of Chance Adomeit. Don had a special love for Joslyn Broder daughter in-law and wife of Craig Broder for whom provided gentle care for him during his time of need. His family and friends will miss his gentle kind words, wisdom and encouragement. Don was courageous, responsible and generous and has worked effortlessly to create this website to bring awareness to Canadian families exposing judicial and health care fraud. When he heard The Wildrose Party had pledged an “Accountability Act” to the people of Alberta he was very hopeful this new act would provide the much needed protection to all vulnerable citizens of Alberta. This website: “Buck For Justice” exposes how the P. C. Government of Alberta current Premier Alison Redford “past Justice Minister” and her predecessors continue to act willfully blind while judicial and health care fraud continues to be committed. Don and Joyce Broder were another example of casualties caused by the corruption within the Federal and Provincial Government and The Alberta Justice Department. Donald Broder has provided the evidence that conspiracy, collusion by specific lawyers and justices for whom were all willful participants in orchestrating the outcome of Alberta Court of Queen’s Bench Action 9703-12949. Judicial Corruption in Canada.
All the information was learned through an investigation conducted by
Donald H. Broder and others after;
The Supreme Court of Canada
dismissed his application for leave in April 2006.
Donald H. Broder filed an action against one of his lawyers; Robert J. Sawers of R. J. Sawers and Associates in December of 2006 for accepting service for the Surrogate Court Application for Probate and not notifying Donald H. Broder
The Law firm of Fraser Milner Casgrane defended Robert J. Sawers and upon filing the Affidavit of Records allowed Donald H. Broder to attend their office to review the producible records.
It was then that documents discovered within Robert J. Sawers file Don discovered the certified copy of the Chief Justice A. H. Wachowich order that was filed at Edmonton Law Courts by Elizabeth MacInnis for which closed the pleadings within action 9703-12949 before the application for probate was filed by Elizabeth MacInnis of Weir Bowen and that she was in a conflict of interest position to act on behalf of the estate and also that the Affidavit of Service for the application for probate was false as Robert Sawers only accept a copy for information purposes as the Estate litigation would have to be a new action for which Donald H. Broder should have been served directly with the application for probate.
It was at this time Donald H. Broder was made to realize that he was suing the only innocent lawyer; Robert J. Sawers was not in a position to accept service on behalf of Donald H. Broder on the Estate Litigation regarding the application for Probate because the pleading were closed within action 9703-12949 for which he was retained as counsel to represent Donald Broder and Craig Broder for which the pleadings had been forced closed and the pending Estate Litigation would have to proceed to The Surrogate Courts to apply for probate and the Application for Probate and Notice to Beneficiaries would have to be service directly on all Beneficiaries and not Robert J. Sawers.
A new Statement of Claim was then filed against Joseph Kueber of Bryan & Company, Guy Lacourciere of Lacourciere Associates, Bryan Kickham of Miller Thomson, and Elizabeth MacInnis of Weir Bowen for not following The Alberta Rules of Court and also acting in collusion concealing that the Pleadings were closed on March 15, 2001 prior to the Application for probate on May 24, 2001.
All the named lawyers were served with a Statement of Claim in November of 2008 at there Law Firm offices for which turned out to be quite an interesting event.
The Calgary Law Courts dismissed all the actions immediately and banned Donald H. Broder from filing any further actions in Alberta without consent of the court.
- Justice Karen Horner told Donald H. Broder during an Appeal of a summary dismissal within a civil action against Elizabeth MacInnis of Weir Bowen that; Chief Justice A. H. Wachowich’s “Court Order” whereby had directed the pleadings were closed within action 9703-12949 on March 15, 2001 was to old to enforce and immediately dismissed the Appeal and awarded costs against Donald Broder payable to Elizabeth MacInnis of Weir Bowen.
- Donald H. Broder exposed to Justice Karen Horner that Elizabeth MacInnis of Weir Bowen had Donald H. Broder at 75 years of age incarcerated for Contempt of Court in April of 2004 for not following a “February 2004 Court Order” when it was ” Elizabeth MacInnis of Weir Bowen``that was in Contempt of Court for not following the Chief Justice A. H. Wachowich previous “Court Order” of February 13, 2001 – for which Ordered Elizabeth MacInnis to file – “The Certificate of Readiness on or before March 15, 2001.”
- Justice Karen Horner would not incarcerate Elizabeth MacInnis of Weir Bowen for Contempt of Court, Fraud on the Courts and Obstruction of Justice; for not following the Chief Justice A. H. Wachowich Order and for also willfully concealing the The Chief Justice A. H. Wachowich Order from the trial Judge – Justice Myra Bielby.
- Donald H. Broder then told Justice Karen Horner that the Courts obviously operate on two sets of rules; “one for Lawyers” and a different set of rules for “the rest of the Canadian citizens.”
- Note: The Alberta Justice Department / Transcript Management has refused to release the transcripts from the Appeal that was heard before Justice Karen Horner.
- Justice Hawko dismissed the action against Guy Lacourciere base on the Statement of Claim being duplicative from a previous action that was also dismissed, when he was asked what was duplicative Justice Hawko read portions of The Original Statement of Claim, it was then realized by Donald H. Broder that Justice Hawko was calling a document that he had not seen duplicative as he was not aware there was an Amended Statement of Claim within the court file. Mr. Broder suggested to Justice Hawko that if he was calling a document duplicative it would be prudent to at the very least have read the correct document, Justice Hawko did not even know the Amended Statement of Claim existed. He then fumbled through the court file and found it, then immediately confirmed it was also duplicative without ever reading it, dismissed the action and left the court room sheepishly refusing to sign the order for costs against Donald H. Broder.
- Master Prowse for whom heard a summary dismissal 129 application for an action against Elizabeth MacInnis of Weir Bowen who told Mr. Broder to get on with his life and find something better to do that you cannot sue a lawyer that won. Even when it was suggested that Elizabeth MacInnis had only won because she had committed fraud by not adhering to the Order of The Chief Justice A. H. Wachowich for which had directed the closing the pleadings and then fraudulently concealing the Wachowich Order from the trial Judge; “Justice Myra Bielby“, Master Prowse went on to suggest that we should write the trial Judge Justice Myra Bielby and request the decision be reversed.
